Terms of Sale and Website Use

The SparkIt store is intended for adults 21 years of age or older.

By placing an order, you confirm that you are at least 21 and that the information you provide to SparkIt is accurate.

Product availability and delivery eligibility depend on the destination and applicable requirements. SparkIt may refuse, restrict, or cancel an order when sale or delivery is unavailable.

SparkIt products must be purchased, possessed, and used only in accordance with applicable law.

Customers are responsible for lawful use of the product after delivery and for following the product instructions and safety information supplied by SparkIt.

Products may not be provided to minors.

SparkIt makes reasonable efforts to present product descriptions, specifications, images, pricing, and availability accurately.

Product information may be updated before purchase as production specifications, packaging, or availability change. The product, price, and other terms shown when an order is submitted govern that order, subject to correction of obvious errors.

Submitting an order is an offer to purchase.

SparkIt may accept, decline, or cancel an order because of product availability, delivery restrictions, suspected fraud or misuse, an obvious pricing or listing error, payment failure, or another legitimate order-processing issue.

If SparkIt cancels an order after payment has been captured, the applicable amount is returned to the original payment method.

Prices are shown in the currency indicated on the website.

Applicable taxes, shipping charges, discounts, and other order amounts are calculated and displayed during checkout before the order is submitted.

Payment is subject to authorization and processing through SparkIt's commerce and payment providers.

Promotional offers, discount codes, and other incentives may have separate eligibility requirements and may be modified or withdrawn prospectively unless otherwise stated.

Orders are subject to the SparkIt Shipping Policy in effect when the order is placed.

Shipping availability is determined from the delivery information provided at checkout. Delivery estimates are not guarantees.

Cancellations, returns, and refunds are governed by the SparkIt Return & Refund Policy in effect when the order is placed.

Nothing in that policy limits rights that cannot legally be waived.

Eligible retail SparkIt TRI products are covered by the SparkIt TRI Two-Year Limited Warranty.

The Limited Warranty is separate from the discretionary return policy and describes the coverage, exclusions, remedies, and claim process for covered defects.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

Notify SparkIt if you believe an account has been accessed without authorization.

The SparkIt name, trademarks, product names, product designs, photographs, graphics, text, software, and other website materials are owned by SparkIt or used with permission and are protected by applicable intellectual-property laws.

You may use the website for ordinary personal shopping and informational purposes. You may not reproduce, commercially exploit, interfere with, or attempt to gain unauthorized access to the website or its systems.

SparkIt uses third-party services for functions such as commerce, payment processing, hosting, delivery, communications, and analytics.

Those services may be subject to their own terms and privacy practices where applicable.

SparkIt does not guarantee that the website will always be uninterrupted or error-free.

Temporary website, inventory, payment, or service interruptions do not alter any product warranty or consumer right that applies to a completed purchase.

To the fullest extent permitted by applicable law, SparkIt will not be liable for indirect, incidental, special, or consequential damages arising from use of the website or a product.

Nothing in these Terms excludes or limits liability, warranty obligations, or consumer rights that cannot legally be excluded or limited.

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules, except to the extent the law applicable to a consumer requires otherwise.

Any dispute that may properly be required to proceed in court will be subject to the applicable state or federal courts in Washington, except where applicable law provides a consumer with another required forum.

SparkIt may update these Terms prospectively.

For a completed retail purchase, the terms and policies in effect when the order was submitted govern that transaction unless applicable law requires otherwise.

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision is limited or removed only to the extent necessary.
